CastOff is an online marketplace operated by Cast Off Co (ABN 38 353 817 791), a sole trader registered in Australia. CastOff connects customers with independent fishing charter operators across Australia. CastOff acts as an intermediary between customers and operators and is not itself a charter operator.
By accessing or using CastOff, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use our platform. These terms apply to all users including customers, charter operators, and visitors.
When you make a booking through CastOff, you are entering into a contract directly with the charter operator, not with CastOff. CastOff facilitates the booking and payment on behalf of the operator. A booking fee of 8% is charged to the customer on each booking. Payments are processed securely by Stripe. By completing a booking, you agree to the operator's specific cancellation policy displayed at checkout.
Cancellations by customers are subject to the operator's cancellation policy, which is displayed clearly before payment. Weather cancellations initiated by the operator are always fully refunded. CastOff reserves the right to cancel bookings in exceptional circumstances and will provide a full refund in such cases. Refunds are processed within 5–10 business days.
Customers must provide accurate personal information including emergency contact details and any medical conditions relevant to participation in maritime activities. Customers must follow all safety instructions given by the operator and crew. Customers who are under the influence of alcohol or drugs may be refused boarding without refund. Customers must comply with all applicable fishing regulations and licensing requirements.
Charter operators listed on CastOff must hold all required licences, certifications, and insurance as required by Australian maritime law. Operators are responsible for the safety of all passengers and must comply with all relevant regulations. Operators must honour bookings made through CastOff unless cancellation is due to weather or genuine safety concerns. Operators are responsible for the accuracy of their listing information.
Fishing charters involve inherent risks including rough weather, physical exertion, and maritime hazards. By completing a booking, customers acknowledge these risks and agree that CastOff and the operator are not liable for injury, loss, or damage arising from participation in charter activities, except where such liability cannot be excluded by law.
To the maximum extent permitted by Australian Consumer Law, CastOff's liability in connection with any booking or use of the platform is limited to the booking fee paid. CastOff is not liable for the acts or omissions of charter operators. Nothing in these terms excludes or limits any statutory rights you have under Australian Consumer Law.
All content on the CastOff platform including text, images, logos, and software is owned by or licensed to Cast Off Co and may not be reproduced without written permission. Reviews submitted by users are licensed to CastOff for display on the platform.
CastOff may update these terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the updated terms. We will notify registered users of material changes by email.
These terms are governed by the laws of Queensland, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Queensland.
