CastOff Standard Maritime Waiver — applicable to all charter bookings made through CastOff
I understand and acknowledge that recreational fishing charters involve inherent risks including but not limited to: rough sea conditions, adverse weather, vessel motion causing seasickness or loss of balance, exposure to sun and elements, handling of fishing equipment and hooks, contact with marine life, and the risk of falling overboard. I voluntarily accept these risks as a condition of participation.
I confirm that I am physically fit and have no medical conditions that would prevent my safe participation in a recreational fishing charter. I have disclosed any relevant medical conditions, disabilities, or medications in my booking details. I accept responsibility for ensuring that all members of my group are fit to participate. I understand that the vessel's skipper has the final authority to refuse boarding to any passenger they reasonably believe poses a safety risk.
I agree to follow all safety instructions given by the skipper and crew at all times. I understand that the skipper's decisions regarding vessel operation, fishing locations, and trip duration are final and made in the interests of passenger safety. I agree not to interfere with the operation of the vessel or the duties of the crew.
I understand that the consumption of excessive alcohol or use of illegal substances is prohibited on board. The skipper reserves the right to refuse boarding or remove any passenger who is intoxicated or under the influence of substances, without refund.
To the maximum extent permitted by Australian Consumer Law, I release CastOff Pty Ltd, the charter operator, the vessel owner, and their respective employees, agents, and contractors from any liability for injury, illness, death, loss, or damage to property arising from my participation in the charter, except where such liability cannot be excluded by law. Nothing in this waiver limits any rights I may have under the Australian Consumer Law.
I understand that trips may be cancelled or modified due to weather conditions, mechanical issues, or other safety concerns at the skipper's discretion. Weather cancellations are fully refunded through CastOff. I agree to the operator's cancellation policy as displayed at the time of booking for customer-initiated cancellations.
I agree to comply with all applicable Australian and state fishing regulations including bag limits, size limits, and species-specific rules. I accept responsibility for my compliance with these regulations and understand that the operator or CastOff bears no responsibility for any regulatory breaches by passengers.
I consent to photographs and video being taken during the trip for potential use by the operator or CastOff in promotional materials, unless I notify the operator otherwise before departure.
I understand that CastOff and the operator accept no responsibility for loss, theft, or damage to personal belongings brought aboard the vessel.
I understand that my personal details including name, date of birth, and emergency contact are included in a passenger manifest for maritime safety compliance, as required under Australian maritime law. This information may be provided to maritime authorities if required.
This waiver is governed by the laws of the Australian state or territory from which the charter departs. If any provision of this waiver is found to be unenforceable, the remaining provisions continue in full force.
By completing a booking through CastOff, I confirm that I have read and understood this waiver, that I accept its terms on behalf of myself and all members of my group, and that I have the authority to bind all members of my group to these terms. This waiver is accepted electronically at the time of booking and the timestamp is recorded against my booking reference.
